The REACH regulation has the potential to significantly impact companies throughout the European Union. It applies to all chemical substances, not just those used in industrial processes but also in our everyday lives. This means that any substance which contains chemicals will be subject to the REACH regulation.
Per European regulations, companies that manufacture and market substances must identify and manage any risks associated with those substances. Companies must be able to demonstrate to the European Chemicals Agency that their products can be used safely and that users are properly informed of any risk management measures. If this is not done satisfactorily, the use of the produced substances can be restricted.
There are four distinct roles to play under the REACH regulation: that of manufacturer, importer, downstream user, and non-EU company.Each party has a different set of responsibilities to uphold in order to ensure the safety of chemicals produced and used across Europe.
As a manufacturer, you have important responsibilities for any chemicals you create for use or supply to others. If you’re importing anything from outside the EU/EEA, you likely have some responsibilities under REACH. And as a downstream user who uses chemicals industrially or professionally, you need to check your obligations under REACH. Companies established outside of the EU are not bound by the obligations of REACH if they import their product into the EU customs territory; instead, the responsibility lies with the importers.
